These Terms of Service (“Terms”) govern your access to and use of outempire.shop and any purchase from OUTDOOR EMPIRE, INC.(“Outempire”, “we”, “us”). By using the site or placing an order, you agree to these Terms.

1. Eligibility

You must be at least 18 and able to form a binding contract. You are responsible for the accuracy of the information you provide.

2. Products, pricing & currency

• All prices are in U.S. dollars (USD) and exclude taxes and any import duties unless stated.
• We may correct errors, change prices, and update or discontinue products at any time before your order is accepted.
• Product images and descriptions are provided in good faith; minor variations may occur.

3. Orders & payment

Your order is an offer to buy. We accept it when we dispatch the goods. Payment is processed by our PCI-compliant provider (Stripe); your statement will show OUTEMPIRE GEAR. We may cancel and refund an order for stock, pricing-error, fraud-screening or shipping reasons.

4. Shipping & returns

Delivery and returns are governed by our Shipping Policy and Returns Policy, which form part of these Terms.

5. Products we do not sell

Outempire sells trunk and off-road accessories only. We do not sell complete vehicles, RVs or campers, loose lithium batteries, or fuel and other flammable liquids.

6. Product safety & assumption of risk

Some products — including recovery ropes, shackles, tie-down straps, trailer hitch hardware, and items used for towing or off-road driving — involve inherent risk and can cause serious injury or death if misused. By purchasing and using them you acknowledge and agree that:

• You will inspect equipment before every use and never use damaged, worn or compromised gear.
• You will not exceed rated capacities and will use only rated recovery/attachment points (never a tow ball for kinetic recovery).
• You will keep bystanders clear of recovery and towing operations.
• You are solely responsible for safe use and for complying with all applicable road, traffic and off-road laws and regulations in your country, state and locality.
• You assume all risk arising from off-road driving, towing and recovery activities.

7. Intellectual property & independence

Outempire is an independent brand. All Outempire names, logos and content are our property. We are not affiliated with, endorsed by, or selling on behalf of any third-party vehicle or accessory brand, and we do not produce counterfeit or imitation branded goods. You may not copy or use our content without permission.

8. Acceptable use

You agree not to misuse the site, attempt unauthorized access, interfere with its operation, or use it for unlawful purposes.

9. Disclaimers

The site and products are provided “as is” to the fullest extent permitted by law. We disclaim implied warranties except those that cannot be excluded under applicable law. Nothing in these Terms limits your non-waivable statutory or consumer rights.

10. Limitation of liability

To the maximum extent permitted by law, Outempire is not liable for indirect, incidental, special or consequential damages, or for misuse of products contrary to their instructions and safety notices. Our total liability for any claim is limited to the amount you paid for the product giving rise to the claim.

11. Indemnification

You agree to indemnify Outempire against claims arising from your breach of these Terms or your misuse of the products.

12. Governing law

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws rules. The courts located in Florida shall have jurisdiction, subject to any mandatory consumer-protection rights in your country of residence.
